Binayak Sen, a social activist and a pediatrician has been denied bail. He has also been sentenced with life imprisonment on which other social activists and his family is very upset.
SOCIAL ACTIVIST, Binayak Sen’s, bail plea was rejected again on Thursday (February 10), by the Chattisgarh High Court. He has been sentenced to life term imprisonment along with Piyush Guha, a Kolkata based businessman, who has been sentenced with the same punishment for anti- national activities.
Sen, a pediatrician had completed his MBBS from the Christian Medical College, Vellore in 1972. He has also been awarded with the Jonathan Mann award for Global Health and Human Rights by the Global Health Council and also the R R Keithan Gold Medal by the Indian Academy of Social Sciences for his contribution in improving the quality of life of the poor and downtrodden people of Chattisgarh.
Sen was arrested in Bilaspur in 2007, on the charges of carrying messages between Piyush Guha and Narayan Sanyal, a Maoist ideologue. In the same year, chargesheets were filed against him under the Chattisgarh Special Public Security Act and also under the Unlawful Activities (Prevention) Act. He was also kept in solitary confinement.
In 2009, Supreme Court questioned the Chattisgarh government about Sen’s detention, as a result of which he was released on bail by Supreme Court. The trial then resumed in the Raipur session court which found Sen, Guha and Sanyal guilty of sedition and sentenced all three of them with life imprisonment. In January, this year, bail appeal was made which faced a rejection on this Thursday.
For Ilina, courts decision was unexpected and she will be appealing to the Supreme Court. Sen, who is the vice president of the People’s Union of Civil Liberties, was charged with sedition, conspiracy and waging war against the state. He was the one who raised his voice against the violence of the security forces and also against the state backed civil militia group Salwa Judum, as a result of which the state government charged him under the Chattisgarh Special Public Security Act and Unlawful Activities (Prevention) Act.
According to Sen’s Counsels, police didn’t have substantive proofs to show that the vice president of the People’s Union has done any such offence, which landed him up under the charges of sedition. On the other hand, additional advocate general Kishore Bhaduri, for the state said that Binayak Sen is not entitled to a normal bail and there are very strong evidences which prove him guilty of having links with the Maoists. According to Bhaduri, Sen claimed himself as a pediatrician, but he never conducted any camp or treated children.
The decision of the division bench says it all, after the state government opposed his plea on the grounds of his alleged links with the Maoists. As the decision was delivered in front of a capacity crowd, it evoked uproar from civil society groups and activists, who are in support of this 61 year old pediatrician. This decision by the high court came as a blow for the civil rights activists and certainly has dashed all their hopes in reference to the judgment.
