MORE THAN 25 years after the toxic gas leak from Union Carbide’s plant in Bhopal killed an estimated 25,000 people and the toll of victims is still rising, the survivors were disappointed after a court held eight officials guilty only of criminal negligence in the world’s worst industrial disaster. The charges under which the accused have been convicted carry a maximum prison sentence of 2 years.
Yesterday, the Magistrate court in Bhopal convicted all eight Indians accused in the 1984 Bhopal gas tragedy case. Their punishment: two years’ imprisonment and an Rs 1 lakh fine. All of them were granted bail. Also, a Rs 500,000 fine was imposed on Union Carbide India Ltd (UCIL) from whose pesticide plant tonnes of lethal methyl isocyanate gas leaked on the night of Dec 2-3, 1984, killing thousands instantly and many more over the years. People are still suffering.
The officials held guilty are the then UCIL chief Keshub Mahindra, Vijay Gokhale, J Mukund, S P Chaudhary, K V Shetty, Kishor Kamdar and S I Quireshee, who didn’t appear in court due to ill health. Another accused, R B Chaudhary, died during the trial.
People responsible for the massacre of over twenty three thousand people and affecting the generations that follow get just two years of imprisonment after a long 26 years of trial & that, too, only to be let out on bail.Despite yesterday’s conviction, there is little closure for victims. Legal experts have alleged that there was an attempt to cover up the case. It took the CBI three long years to file a charge sheet that many believed was weak. Then in 1996 the charges were watered down making all sections carry the maximum punishment of 2 years. Every possible opportunity was given to culprits.
The charges were also all bailable and with the prime accused in the case, former Union Carbide (USA) chairman Warren Anderson is still on the run and unlikely to present himself in Indian court, there is little hope that justice will be served.If this was the decision why they waited for 26 years? Hope anyone can answer. It is a black day for Bhopal gas victims; the judgment has made a mockery of the sufferings of the people of Bhopal. It is really pitiable that it takes over 25years to take action on culprits. The Indian judiciary and government should hang their head in shame. The only thing I can say is this is a very good example of law taking its own course but after 26 years. Our Indian judicial system should be awarded for breaking the snail's speed record. I do not know whether this is because of corruption or because of fundamental flaws in the system itself. I will not be wrong to say that our judicial system is inefficient and ineffective. It needs to be revamped thoroughly. Judiciary is to me made accountable as any other system is.When the judicial system failed to hang the culprits, its very sad to know that the Bhopal Gas disaster victims will be hanging nearly 64 effigies of the accused, including that of Warren Anderson, the then chairman of Union Carbide Corporation, USA.They are preparing the effigies with their meager resources and the victims said, hanging them gives them some peace of mind. This is a grave miscarriage of justice. Twenty-six years and still there is no proper settlement in sight. What one can say about the efficiency and the promptness of our judicial system? Sometimes I feel that our country is heading towards failed state. No one owns the responsibility of any task given. I honestly feel Justice is snatched from the common man.Justice delayed is justice denied which is true beyond doubt in this case of unparallel human tragedy.

During this, existing surge of scientific developments the computers and communication media has seen tremendous changes, bringing the world together with free exchange of thoughts and ideas amongst engineers,scientists, doctors etc and thus the judiciary kept at high esteem for nothing is now exposed,every professional in its kind is important i.e. as the CJI of Karnataka who is itself not respecting the professional seat of supreme held by him itself is regretted to note. The enlightened do not want miscarriage of justice, unreasonably dragged cases in courts with administrative deficiencies and defects in the legal process faced by the innocent clients as in the case of cheque bounce case, land grabbing case of an ex-serviceman in Bangalore City Civil Court i.e. O.S.345/2004 & R.A.117/2009. Its high time CBI be asked to look into the case and give justice to this innocent ex-serviceman orelse it is discouraging the citizen to come forward to defend their nation. God the almighty to come to the rescue of the suffering innocent citizens of India.
If by mistake ex-CJI Ahmadi and other similar thinking judges are asked to stay in methyl-iso-cnate Gas chamber for two minutes, no one will be liable for loss of life.
