Hyderabad-based realty firm, Happy Homes Housing, was pulled up by the A P State Consumer Disputes Redressal Commission (APSCRDC) for irregularities in construction and handing over of flats without completion of civil works.
HAPPY HOMES Housing, a Hyderabad-based realty firm, was pulled up by the A P State Consumer Disputes Redressal Commission (APSCRDC) for irregularities in construction and the handing over of flats without completion of civil works and the provision of other amenities as per HUDA norms in its residential complex at Upparpally, GHMC Rajendranagar Circle. In a verdict given in favour of Happy Homes Housing Palace ‘A’ Flat Owners Welfare Association, the State Commission ordered the firm to complete the leftover works, and pay Rs5,000 each towards compensation to all the owners.
The firm handed over the flats to the owners in November 2002, while the construction was under progress. Even after a year, the company did not start the works, which caused uneasiness among the owners. The firm has answered all the letters from flat owners and has postponed all work. Vexed with its attitude, TR Madhavan, Vice President of the Palace A Flat Owners’ Association, along with twenty other flat owners moved the APSCRDC seeking completion of pending works in compliance with the sale agreement or the payment of Rs45 lakhs to them.
In defence, the association also lodged complaints with the government of Andhra Pradesh, Rajendranagar municipality, fire department and the director of town and country planning. Defending its case, the company came up with arguments like, the complainants were not members of the Flat Owners’ Association, the association itself was an unauthorised group since its office-bearers were not elected by members and that most of the works were already completed.
However, after going through the evidence, the APSCRDC observed that the construction process was full of irregularities and that some of the company’s arguments were also incorrect. It ordered the firm to complete the remaining work within three months and to pay compensation to all the flat owners who were members of the association on the date of complaint and also cover court costs.
