Corrupt are united
According to Justice AK Ganguly, who was part of the judicial panel that struck down the 2G licenses, the judiciary is a platform where the interests of a common person are protected against people who are united in corruption.
The corrupt are united, and this was what was told to the media by Hon’ble Justice A K Ganguly in his exclusive interview with a Hindustan Times correspondent. Justice Ganguly was of the opinion that the Judiciary alone can’t fight them. On the 2G spectrum scam he commented it was the result of governance failure completely.
There is increasing unrest amongst the general public against corruption and even politicians are now quite hesitant to give tickets in elections to candidates having a crimnial background.
Justice Ganguly's opinion abotu the 2G scam case was that it was "motivated and unfounded". In a separate judgment on sanction to prosecute corrupt public servants he recommended that our Parliament should fix time frame to accord prosecution sanction for them to punish them - if found guilty .
He further added that the restraint on judiciary matter must be understood in relative terms only. The line of restraint is always flexible and adjusted for the ends of Justice and in the public interest.
There can be difference of opinion among the Judges even but when the Court is to uphold the rule of law and protect the citizen's rights, there can’t be fixed parameters and hence there can be flexibility here and there, it depends.
