In most countries, the law demands evidence from a medico proving that a woman has been forced into sex. For such proof, a woman must be examined within 24 hours after the rape. In some cases, a defense lawyer may try to cast doubt upon the woman's story by asking about her past life. The jury may conclude that a woman has low morals and willingly consented to sexual relationship, if she had sexual experiences with several men in the past.
As far as the case of the Asaram Bapu case goes, it is very unfortunate that a new story of political involvement of various political parties to save the culprit has come to light. This is a disgrace to Indian democracy.
Due to vote bank politics, ruling party as well as opposition parties are strongly advocating to save the culprit. It is unfortunate for the nation that at the cost of minor girl’s molestation, both parties are speaking the same language with same script. Therefore, after a week passed, neither has he been arrested nor have been called for police enquiry. I am sure, in hope of getting more votes from public ,both prominent parties will loosen their vote bank. After having talked with prominent personalities including college professors, medicos, social reformers, members of Lions /Rotary clubs etc. They share a common feeling - not to vote to either party who are supporting the so called Sadhu of 74 years.
The Lok Sabha on Monday also demanded a stern action against Asaram Bapu. In such cases, the law takes its own course, as they are dealing with known personalities. But, it is not that the Indian judiciary or the police are slow, but they do things at their own whims and fancies. If they want to arrest the persons involved, they do not need much time, as was witnessed in the Mumbai gangrape case, where five people were arrested. But the so called 74 years sant has still not been arrested.
The case has even reached the parliament, as it cropped up during the zero hour while the discussion for the Mumbai gangrape was taking place. "There is one sadhu who is taking the country for a ride. What have you done in the case? A young girl has slapped rape charges against him. Government should say something and do something on this. Why don't you speak on this,” Janata Dal (United) chief Sharad Yadav told Home Minister Sushil Kumar Shinde after making a statement on the Mumbai gang-rape case, reported Hindustan Times.
It is true that ,punishing this sadhu will definitely send a strong message across the country. People like Uma Bharti, Neelam Dube, Archna Shama, all are advocating to save the sant for sake of some monetary and politically gain.
Several members including Gurudas Dasgupta (CPI) demanded stringent action against the controversial godman. It is again astonishing that the members of Lok sabha wanted to speak more on this subject but were not allowed by Speaker Meira Kumar, a woman herself.
Responding to the members, Mr. Shinde said cases like those of Asaram Bapu and the Jharkhand constable who was gangraped were “primarily the concern of states.” This type of answer from country’s Home Minister was not expected at all. He further said: “They are in preliminary stages of investigation. I don’t have information on them. Whenever I get the information, I will inform the House.”
