Do justice to applicants of building penalisation scheme of 2008 - Reconsider property tax levies
The flat owners of Happy Homes Residential Complex, under Greater Hyderabad Municipal Corporation Rajendranagar Circle 6 limits have petitioned to the Hon'ble Minister of Municipal Administration & Urban Development, Govt. of Telangana, protesting against the notices issued to them revising the property tax and levying unauthorized construction penalty indiscriminately.

In their petition it is stated that, during the last financial year 2015 -16 property tax was charged to almost all the flats in all blocks in the complex, at a flat rate of Rs. 101/- as per the G O Ms. No. 6, dt: 5/1/2016 and several of them did received sms from GHMC till recently Dec. 20, 2016 asking us to pay the same amount what was charged last financial year, an amount Rs. 101/-.

They have strongly objected to the revised property tax which is on the higher side. They say that, "As per the MAUD(A2) G O Ms No 6 5/1/2016 clearly says that residential building occupied by the owner, wherein the Annual Rental Value does not exceed Rs. 4,100/- (i.e., Rs. 1,200/- Property Tax per annum) subject to condition that the beneficiaries of exemption shall pay a nominal amount of Rs. 101/- per annum towards Property Tax. There's no mention in G O the flats are not eligible for such concession in property tax."

They have raised a question that, if the flats were not eligible for the nominal amount property tax why did the GHMC collected it during the last financial year and now during the fag end of the financial year revised it to between Rs. 1200 to 1800 per annum and issued notice? Why the GHMC did not issued any notice for collection of unauthorised construction penalty during starting of this financial year or during last financial year?

Further a flat owner said, "On search in the GHMC website under "Town Planning Pending Files Information" link page found a sub link showing "BPS Pending Applications". Under that, information of BPS applications of the year 2008 are pending due to various reasons of following Circles 1 to 10 and 14 & 16."

"It was surprising that, all other Circles uploaded the details pending applications due to various reasons even after making full payments, Rajendranagar Circle 6 information available is of only 7 applications without proper reasons."

"As far as our complex area is concerned there are several hundred lower and middle class applicant's files are pending, even after payment of full penal amount as well as to pay balance penal amount."

The flat owners say that, the GHMC should also have uploaded the pending applications of 2008 of those who have not paid balance penal amount.

They were also surprised that, why the GHMC officials have not brought to the notice of the Government to clear the pending applications along with new applications were allowed as per new G O issued in 2015 by your government, when it was an additional income one as well as the applicant's property especially a flats in a block would be a secured one.

"As the data of all properties under BPS 2008 including of applicants from residential apartments are available online with the GHMC, the flat owners of Happy Homes Complex humbly requested the Government instead of levying unauthorized construction penalty, it will be highly appreciable if the Government issue fresh orders applicable only to those pending applications applied under G. O. Ms. No. 901 MA, dt: 31/12/2007, make the balance payment as levied at that time as per G O issued."

They do hope that, a people friendly government will consider the request and issue necessary orders so that, given an opportunity the applicants will fulfill the formalities and make their properties secured.
