The proposed amendment aims to plug the hole in this regard and ensure that a estranged partner is able to get a divorce, even if the other party does not come to court or willfully avoids the judicial system.
TO EASE the legal problems faced by couples going for a divorce, the Union Government on Thursday approved an amendment to the Hindu Marriage Act. As per the new regulation, the irretrievable breakdown of marriage has been made an additional ground on the basis of which divorce can be sought.
This amendment has been introduced to ensure that there is no harassment when two parties seek divorce mutually but one of them fails to attend court to harass the other. The amendment would come into force after it is ratified by the parliament. It is pertinent to mention that despite most of the marriages being arranged by families in the country, there has been a huge increase in the divorce rate in the country. In majority of the cases where couples seek divorce, one of the partners is found to be using the legal loopholes to harass the other party.
The proposed amendment aims to plug the hole in this regard and ensure that a estranged partner is able to get a divorce, even if the other party does not come to court or willfully avoids the judicial system.
