Govt misusing CBI for political purposes?
DMK ministers resigned from Union Cabinet on 20 March after announcing withdrawal of support to the Congress-led UPA government a day earlier. Mulayam Singh Yadav till this time was unrelenting over the issue of Union Minister Beni Prasad Verma, suddenly became soft towards the UPA government. And then suddenly Central Bureau of Investigation (CBI) raids MK Stalin, the number-2 in DMK in early hours of 21 March.

It may be co-incidence or otherwise that DMK was taught a lesson for separating from UPA government, and Mulayam Singh Yadav got a warning that there were strong cases against him too pending with the CBI.

New draft of Lokpal Bill as approved by Parliamentary committee provides fairer selection of CBI chief. But the style of parliamentary working in India cannot ensure easy and early passing of this longest pending Bill in the Parliament.

Best will be to implement some important provisions of drafted Lokpal Bill like selecting CBI chief with consensus of Opposition leader through separate legislation at the earliest without waiting for passage of Lokpal Bill. CBI should again be placed under RTI Act. Section 8 of the Act has sufficient provisions for denial of information including the one impeding investigating process.

Central Information Commission (CIC) should review its decision to adjourn indefinitely petition against CBI for information on corruption cases against four former and present Chief Ministers because of a stay order granted by single Bench of Delhi High Court, as a Division Bench of Madras High Court has finally decided a similar matter against another agency listed under second schedule claiming exemption under section 24 of RTI Act ordering providing of sought information.

Otherwise also, a stay-order on a particular matter cannot be a precedent for all other matters. Or else, a stay-order on some eviction case can automatically stall lakhs of other such cases.
