India is the first country in the world to give Eunuchs the right of calling themselves as Third Gender, thanks to the judgement of the Supreme Court of India. Earlier, they had to write their sex as either male or female. Now, they will be able to write Third Gender against the sex column in the various forms.
Moreover, the Supreme Court has directed the Central Government and all the State Governments to treat them as socially and economically backward people and give them reservations in educational institutions and Government jobs that are available to Other Backward Classes category.
The Supreme Court has also directed these Governments to build special toilets for them and give them medical facilities and all the human rights. However such facilities will not be available to Gay, Lesbian, Bisexual and Queer people etc. who also call themselves transgenders. The term will only apply to Eunuchs.
The Supreme Court of India has given this direction on the petition of the transgender Rights activist, Laxmi Narayan Tripathi who appreciated the judgement of the Supreme Court very well. If a person changes his or her sex through surgery, he or she would be able to make use of the changed sex, according to the Supreme Court judgement.
The Supreme Court has also called upon the Central and State Governments to create awareness among the masses to remove social stigma against the eunuchs. Thus full human rights would be given to the eunuchs.
