CHIEF JUSTICE of Delhi AP Shah should be complimented for his retiring gift to users of RTI Act at Delhi High Court when he, in his capacity as Competent Authority of the RTI Act, decided to further amend RTI rules at Delhi High Court to be in tune with provisions of RTI Act. Earlier also, he had got modified RTI rules to a great extent which were originally drafted absolutely in contradiction of the RTI Act itself.
However Union government should repeal sections 27 and 28 of RTI Act giving often-misused powers, to states and competent authorities to make their own RTI rules to make the transparency-Act uniform and same for all states and public-authorities. Presently many states and public-authorities have drafted their own RTI rules which are contrary to even basic sections of the RTI Act itself. Repealing sections 27 and 28 will automatically remove all confusions about different amounts of RTI fees being charged by public-authorities.
