IN THE much hyped child-sacrifice incident that occurred in Sambalpur’s Adthpathar village under Jamenkira police station limits last year, the Odisha High Court has awarded life imprisonment to the accused. The accused was the grand father of the child, who was living with him after her mother married again.
The division bench of High court comprising of Justice P Mohanty and Justice SK Mishra passed the order of life imprisonment against the accused modifying the judgment of the ADJ Kuchinda. Earlier ADJ Kuchinda SK Pati passed death sentence against accused referring it as a rare incident in civic society and sent the order for confirmation of high court. The incident that took place on April, 26, 2009 was perhaps a rare case in the human society. The accused, 55 years old Rajesh Kandulana, who was taking care of his only grand daughter hacked her because he wanted to mix virgin blood with the paddy seeds in order to increase his paddy production. The accused a man of tribal community was of firm belief that his production would increase after appeasing his presiding deity ‘Dharni Penu’ (mother earth) with virgin blood, sources said.
The child a 10 year-old girl studied in nearby village school in class 4th and lived with her grand father in her maternal house at Adthpathar. Though the accused has three sons they live separately since their marriages. The ill-fated day being Sunday most of the villagers including accused's sons (residing near by) went to church for prayers. Taking the benefit of the situation, Rajesh cunningly sent her wife to fetch some grocery items and locked the door inside. The innocent girl Bernica could not notice the intention of her grand father. Rajesh at once cut her throat with an axe and packed her head in a bag. He collected blood in a pot and mixed with the paddy seeds kept in the room. When Rajesh wife came and saw the beheaded body of her grand child, she screamed and shouted, the villagers assembled in the house hearing her scream. Later, police rushed to the spot after getting information and recovered the dead body. Police registered a case and arrested the accused who confessed before the police to have done to increase the paddy production. “The session’s judge at Kuchinda after examining the witnesses and other documentary evidences passed death sentence against the accused Rajesh on May 21, 2010 and sent it to high court for the confirmation of the order,” additional public prosecutor of Kuchinda, Rabindra Nayak said. “In the judgment he mentioned it was a rare case in the civic society,” Nayak said. But the division bench of the high court repealed the judgment of death sentence and changed it to life imprisonment. As per the bench there were neither any eye witnesses nor a chain in circumstances.
