It is noteworthy that CIC-verdict allowed disclosure of the very same information is challenged by Supreme Court in itself by passing normal jurisdiction of Delhi High Court.
JUSTICE KHALIFULLAH of Madras High Court deserves all appreciation for disclosing the name of Union Minister and his lawyer-friend who approached Justice R Raghupati of the same court. It is noteworthy that CIC-verdict allowing disclosure of the very same information was challenged by Supreme Court itself by passing normal jurisdiction of Delhi High Court.
It is not understood how Supreme Court feared an attack on independence of judiciary if CIC-verdict allowing naming of approaching Union Minister and lawyer would have been accepted without resistance. Rather such naming can be instrumental to further strengthen independence of judiciary when influential ones like Union ministers would hesitate doing so in fear of being named. Chief Justice of India should make it compulsory for everyone in the judicial system to mention complete details about approaches and influences including names of those approaching in court-proceedings. Simply exhibition of honesty by transferring the case in case of approach is meaningless till the approaching ones are exposed and punished accordingly.
It is important that transparency should be enhanced in the judicial system, so as to restore the faith of people in the entire process, which has been shattered due to delayed delivery of justice as well as corruption at the lower level, which now appears to be permeating even higher judiciary.
