AFTER THE union government has failed to take steps to appoint a new chairperson of NHRC, the confusion and uncertainty, regarding a new Chief Information Commissioner (CIC) has only risen, making activists take up matter of appointments at these two posts, to the courts.
The outgoing Chief Information Commissioner Wajahat Habibullah, submitted his resignation long back in October 2009, while his intention to join as first Chief Information Commissioner of Jammu and Kashmir was known even earlier. The government should pre-plan appointments to important posts so that these may not lie vacant even for a day.India should adopt a US like system, where the state government may float some names for new Information Commissioners for public comments, apart from sending these to the opposition leader for his consideration. The CIC should then be appointed by rotation for one year each, from amongst the information commissioners on the state level, like is system of appointing the Dean of Management-Faculty at Delhi university.
Such a system will avoid any displeasure amongst existing Information Commissioners, who might in case of the appointment of an outsider, feel bypassed. It would also give the system of governance of the commission multiple advantages like, inducing a healthy competition to deliver the best and providing fresh new ideas to increase efficiency.
