Since a person can't represent two constituencies or become member of both parliament and state assembly, no person should be allowed to contest from more than one constituency or for both parliament and state assembly.
OUR POLITICIANS have made mockery of Indian democracy because of flaws in election rules. Unnecessary by-elections are frequently caused for personal reasons of politicians. Firstly, Hemant Soren resigned Rajya Sabha seat after he was elected to Jharkhand state assembly with an eye on the post of Chief Minister. But now when his father Chief Minister Shibu Soren has to fulfill mandatory requirement to enter Vidhan Sabha, Hemant Soren is resigning from his membership of state assembly to pave a way for Shibu Soren to enter state assembly. There have also been instances when a chief minister of a state has unduly enjoyed simultaneous membership of parliament.

A sitting MP/MLA should resign first from his earlier post before filing nomination for the other seat. Parliamentarians on being appointed ministers in states should automatically lose their parliament seat and vice versa. Security-losing persons should be barred from contesting elections for next six years. There should be a ban of six years on losing candidates to enter Rajya Sabha to avoid making Upper House as dumping ground for rejected candidates. However, constitutional provision of Legislative Councils in states should be altogether abolished.
