The election of an independent MLA Ramesh Rout from Athagarh Assembly segment was declared as null and void by the Orissa High Court on June 23, 2010. The court also ordered the competent authorities to conduct fresh elections in the segment.
IN A hard hitting judgement, the Orissa High Court on June 23, 2010, declared the election of an independent MLA Ramesh Rout from Athagarh Assembly segment as ‘null and void’. The court also ordered the competent authorities to conduct fresh elections in the segment in accordance to the law. Rout once again went to the high court with a request seeking stay for at least two months so as to enable him to move to the Supreme Court. The high court on Tuesday (June 29), refused the request of Rout to grant any relief to him and instead asked him to move the apex court within 30 days if he desires.
The high court ruling had come while adjudicating over an election petition filed by the senior Biju Janata Dal (BJD) leader Ranendra Pratap Swain, a former four times MLA representing the constituency since 1990. Although, Swain was the party candidate for 2009 polls yet he was not allowed to contest for his nomination papers were rejected by the then returning officer Rajesh Prabhakar Patil, who is the collector and district magistrate Koraput.
Returning officer Rajesh Prabhakar Patil rejected his papers on the ground that the official BJD candidate was not supported by the original party ticket along with his nomination papers. The high court also surprisingly quashed the orders of the returning officer. Now the constituency is running without people’s representative.
