Real Estate Regulation Bill is still in draft stage since 2005, due to stiff opposition from the construction lobby. If the government feels the construction industry needs regulation to protect consumer's interest, the bill should be passed at the earliest in the present form with more tooth.
THE MINISTRY of Urban development had prepared the draft bill in 2005, now it has again been re-drafted by the Ministry of Housing and Urban Poverty Alleviation. Still, the construction industry considers the bill as a tool of harassment. How long the government wants the buyers to be taken for a ride by the reality industry?

In the state of Andhra Pradesh Department of Municipal Administration, based on the draft bill, did issue a G. O. Ms. No. 86 in 2006 called as Hyderabad Revised Building Rules, 2006. Within a period of 12 months several amendments were brought in the rules. In it provisions were made to set up Constitution of Enforcement Authority, Town Planning & Building Tribunal and Building Ombudsman. The civil society and consumer expected that the government will take immediate steps to constitute authorities. But till this date the government is silent on the issue.
The municipal authorities did take action as per the G. O. Ms. No. 901 MA/2007 and Hon’ble High Court orders against several constructions in some parts of the Hyderabad and Secunderabad. But in some areas they are yet to take action against the violations. If the consumers have taken steps against the builder/developer they are put to lot of harassment and mental agony due to the negligent attitude of the authorities.
The power of the bill, mechanisms and mandatory things are a good move. Still, consumer feels that if the government wants the bill to be a real game changer, there should be a mandatory clause that “registration of the commercial spaces or flat should be allowed only after the builder/developer gets necessary certificates of structural stability, fire safety measures, occupancy certificate and other mandatory amenities. The copies of the same should be attached as additional documents along with the approved plan at the time registration of the property.” This will be a solution to the consumer grievance related to the industry.
