If you look at the history of police atrocity in the country the 1861 police manual act was made to suppress the 1857 revolt and police stations were made by the British. Even today our police functions on the same 1861 police manual act on the footprints of the British and hence works on at the behest of the administration, powerful, mafiaso, to curb any sort of democratic voice when and as raised.
A glaring example of the police functioning is the bogus case lodged on June 19, 2013 against me and Shruti Nagvanshi by the Bhelupura police in Varanasi district with crime number 1999/13. The bogus case was lodged on the request of husband of a victim of domestic violence.
The victim was being helped by this citizen journalist . The cops lodged the bogus case on the basis of a letter written to the chief medical officer of the district by the husband and ironically cops lodged the case for dowry though me or Shruti is nowhere related to the woman.
This was also a contempt of the court order, as on March 18, 2013 the honourable high court had given judgement in the favour of the victim against the writ petition 8753/2013.
Also when I was attacked by miscreants and was shot at on April 25, 2013 the cops initially refused to lodge an FIR for the attack. When pressure was mounted by senior cops a case was lodged by Cantonment police station 359/13 but even as 90 days passed by neither investigation was done nor did the cops filed a chargesheet.
A letter was written in this regard on June 18, 2013 stating that Sunil Gupta, the husband of the victim has admitted his relation with mafias in a conversation which has been recorded and the tapes/CD were handed over to the police.
The police officers didn’t heard the tape and neither said they could identify or not the voice. They even forgot to mention in their report about the CD given to them but people hear Sunil Gupta and are afraid of him. Even the union home ministry has taken cognizance of the matter and is serious.
In the case another thing happened. Sunil Gupta copied the pictures of Shruti from her facebook account and made obscene comments after posting those pictures in his facebook account in May 2013. A complaint was lodged against him under the IT act with the Cantonment police station 418/13 but the cops have failed to take action or even file a chargesheet in the case till yet.
On June 26, 2013 a delegation of 8 members from the PVCHR met the chief minister Uttar Pradesh Akhilesh Yadav at his residence and gave him details of various cases in the presence of DG UP police. Several case files related to me (Lenin Raghuvanchi) and Shruti were handed over to him and action was taken in almost all the cases but the above matter was again put under the wraps by the Varanasi police.
On September 02, 2012 a plea was made with the local administration to provide legal support to the victim of domestic violence as she was mentally and physically tortured by her husband Sunil Gupta but she got no help. The victim had approached the PVCHR for support and help, which the organisation decided upon and did advocacy to save her life.
On the other hand, I got threats from anti-social elements for supporting the woman about which an application was submitted on January 25, 2013 to the local administration, national human rights commission and along with a global request was made through an urgent appeal. The email detailed about the threatening.
Taking cognizance of the letter the national human rights commission registered a case 4419/24/72/2013 and issued notice to senior superintendent of police Varanasi. The SSP PD Prasad sent his report on June 3, 2013. It was mentioned by the commission that if action is not taken then under section 13 of the human rights protection act 1993 action will be taken.
Irked with the development the Bhelupura police in Varanasi district took note of the letter written by Sunil Gupta on May 28, 2013 and registered a case 199/13 against me and Shruti on June 19, 2013 under section 342, 384, 498.
It may be recalled here that secretary of the human rights department of the union home ministry Nalin Ranjan Singh had demanded a report from the registrar human rights about the victim Sapna Chaurasia wide his letter 15011/26/2013-HR II, along with the letter a delegation of PVCHR met the commission chairperson Justice Shri KG Balakrishna.
On June 26, 2013 when the delegation met the chief minister of Uttar Pradesh Akhilesh Yadav, it narrated the stories of police atrocity, fake cases and suppression of deprived class by the cops before the DGP Uttar Pradesh. In majority cases action was taken and in a few cases the proceedings are still going on but this particular case was not only remained ignored but also the cops in Varanasi are mum about it.
The condition of human rights workers in the entire nation is saddening. Whoever raised his voice for establishing the rule of law and equality is facing opposition at local and national level from the capitalist forces and cops play an important role in this act. Irom Sharmila, Vinayak Sen, Shaila Masood, Sanjay Singh, Parvez Alam are some of the names who have either been eliminated or have been implicated in bogus cases.
To stop such a suppressive attitude of the police and to establish the rule of law, the PVCHR has started Satyagrah campaign from August 15, 2013. Under the campaign a 15 feet flex sheet has been sent to the chief minister, DGP demanding rule of law.
Under the Satyagrah a total 60 demands have been raised by the people and Satyagrah continues in various districts such as Varanasi, Mirzapur, Sonebhadra, Jaunpur, Ambedkarnagar, Aligarh, Muradabad, Meerut. They have sent to the chief minister a signed memorandum in regard to their demands. In all a daily 2 hours Satyagrah is being observed in 22 districts.
This is the first phase of Satyagrah and if rule of law is not established we shall go for a second phase under which lok vidyalaya will run at village level where discussions will be held upon problems of the people and will be forwarded to chief minister and national human rights commission. Bicycle rally, barefoot march and other human rights campaign will be carried out where more organisations will participate.
There will be a website on Satyagrah in Hindi as well as English to decide agenda for the 2014 Lok Sabha elections.
The Satyagrah has been supported by Nepal’s INSEC, renowned journalist Palash Bishwas, Ram Puniyani, former IG Jyoti Swaroop Pandey, Sanjay Gathiya human rights worker from Thailand, UP HUman Righta Law Network, Sikram of Bangaluru and Keritass India. Apart from these peopl at many places in the country lit up candle in support. Indo-Germany Society of Remside Germany also observed candile light vigil in support.
During the Satyagrah 2000 dalit, backward, tribals and minority group people came to participate.
