SC upholds 4% quota for AP Muslims
The Apex Court passed an interim order on Thursday, in which a Bench headed by Chief Justice K.G. Balakrishnan extended the benefit of 4 per cent reservation in jobs and education to 14 other backward classes of Muslims in Andhra Pradesh.

THE SUPREME COURT has upheld reservation for backward Muslims in government jobs and educational institutes in Andhra Pradesh.
The Apex Court passed an interim order on Thursday, in which a Bench headed by Chief Justice K.G. Balakrishnan extended the benefit of 4 per cent  reservation in jobs and education to 14 other backward classes of Muslims in Andhra Pradesh.
 
The Apex Court also quashed the Andhra Pradesh Reservation for Socially and Educationally Backward Classes of Muslims Act which was passed in 2007.
 
Also the court refused to grant quota benefits to the 15th category of Muslims mentioned in the Act as the social group was not specified as backward. The Andhra Pradesh Regulatory Act for reservations to Muslims had a clause saying that even this unidentified category could be considered for quota benefits. This, however, was put on hold by the Supreme Court. The constitution bench is expected to take up the case in August as it is clear that this is a temporary measure.
 
Noted lawyer, Harish Salve has criticised the government for bringing in a law that gave priority to religion over class. Attorney General G.E. Vahanvati, representing the state, said the Act was not religion-specific; its criteria was socio-economic backwardness.
 
The reason for giving four per cent quota to backward Muslims in Andhra was because they constitute 5-6 per cent of the state's population. Those who earn over Rs 4 lacs annually, children of class-I, officers working with the state/central governments and those who hold constitutional posts are not entitled.
