SC upholds death penalty of Nirbhaya's rapists: Is capital punishment a deterrent?
After Supreme Court rejected the 'death penalty' review of Nirbhaya's rape-murder convicts, the debate on capital punishment has once again started. Although many have appreciated the apex court's verdict, activist groups like Amnesty India have argued that death penalty is no deterrent for a crime.

I just reject the claim that since two-thirds of the world's countries have abolished death penalty, India too should abolish it. My point of view is that death penalty still exists in countries where two-thirds of the world's population resides. We must debate whether rapists should be hanged or not, but before that, let's deliberate whether capital punishment is a deterrent.

Human beings are anarchic by nature and prone to commit crime by default. To regulate them it requires laws, rules and systems. No law, rule and system can be enforced without the provision of punishment for violators. No punishment can ever be a deterrent to any crime especially for those who don't care about law and order. But then, majority of the population can be considered as being afraid of punishment. Thus, while no punishment can deter criminals but for average people this can be a deterrent. Even in this informed age, people are afraid to visit a police station and so would avoid committing a crime. Despite given the fact that punishment can't deter a crime, if we stop punishing the violators then the society will be overwhelmed with chaos.

As death penalty is also a type of punishment (highest degree of punishment), it too is required. Yes, some people even don't care about death penalty, but then, there are many people for whom this works as a deterrent.

Now coming to the question, should rapists be hanged? In my opinion there should be provision of death penalty in our criminal jurisprudence for rarest of rare crimes like Nirbhaya's rape and murder.
