Self regulation for lawyers is important
It refers to proceedings in Supreme Court wherein senior counsel KK Venugopal expressed that he would lose almost all his clients if he followed advice of Justice Markandey Katju for avoiding taking cases of persons guilty.
IT REFERS to the proceedings of Supreme Court wherein senior counsel KK Venugopal expressed that he would loose almost all his clients if he followed advice of Justice Markandey Katju for avoiding taking cases of persons guilty of charges like that of cheque-bouncing!

Even though the noble advice was lost in laughter, yet it is important that a mechanism should be evolved for discouraging lawyers from taking up admittedly false cases. It may practically bring down crime-rate and number of court cases.

Also, Union government should impose extra responsibility on lawyer-community. Many lawyers take up cases of established criminals in media-highlighted cases for ‘free’ publicity in media. Interviews or naming of lawyers of accused must be banned. Formality of getting documents attested by notary public and oath commissioners should be abolished making lawyers to attest for their clients.

Costs put by courts on parties are traditionally pocketed by advocates. Costs must be paid by Payees’ Account cheques/drafts in name of opposite party. Lawyer-client agreement about fees should be compulsorily put on the suit-file to avoid in-between blackmailing about fees, and stray incidents of obliging judges by taking free cases of their relations/friends.

Misconduct of lawyers in capacity as local commissioners should attract punishment and cancellation of licence to practice. Such reforms though appearing against privileges enjoyed by lawyers will ultimately be beneficial for lawyers themselves to ease out competition by unending stream of youngsters joining legal profession as only remedy to earn livelihood!

In addition to this if a lawyer fails to prove the innocence of his/her clients his pracitcing license should be cancelled for five years. This will act as a check for the temptation to earn fly by night.
