SONIA GANDHI, who in her capacity as chairperson of National Advisory Council (NAC) was instrumental in gifting the nation ‘Right To Information Act’, has again stepped up to save the RTI Act from being diluted at hands of Union government’s nodal-functionary Department of Personnel & Training (DoPT), when a newly constituted NAC is now supposed to first go through any proposed amendments to RTI Act.
Otherwise DoPT which was supposed to be a helping agency to promote RTI Act, has itself become the biggest hurdle in getting best out of country’s finest post-independence Act which has given country a second freedom by way of transparency and accountability in governance at all levels. DoPT circulars are aimed to educate public-authorities art of harassing users of RTI Act. Neither RTI Act should be diluted in any form as desired by DoPT, nor judiciary should be exempted from RTI Act. Only those who have some malpractices to hide, cry for exemption from RTI Act.
However simple administrative modifications like a Chief Information Commissioner, provision of review of CIC decisions by a higher bench at CIC, penal-provisions for first Appellate Authority or for not complying with section 4 of RTI Act can be made. Need is to repeal sections 27 and 28 of RTI Act to remove all confusions and to bring uniformity in respect of RTI rules and fees same for all public-authorities and states.
