Suraj Pancholi guilty of Jiah Khan's death or a scapegoat?
An advocate this citizen journalist spoke with said that circumstantial evidence against Suraj Pancholi is strong and that he is not out of trouble. But members of the Hindi film industry say that Jiah's 'depression' should not be held against Suraj, and that one 'child' of Bollywood has been lost and we should not lose another one, namely Suraj due to the court case.

Suraj Pancholi has been arrested on charges of abetment to suicide and would be held in jail till June 27. The arrest took place after a six-page letter was discovered in Jiah's wallet box three days after her death by hanging. In the letter, she has blamed the person to whom she was writing (since no one was addressed in the letter by name) that she had suffered abuse, rape and abortion in the relationship.

Media had reported that Suraj Pancholi was apparently admitted to the Juhu Police of beating Jiah Khan 6 months prior to the incident, after which she slit her wrists.

The media, however, also reports that Suraj apparently went to Rabiya Amin (Jiah's mother) on May 18 claiming Khan to be unstable and asking her to be counseled. Zarina Wahab, Suraj's mother is on the other hand certain that the boy she raised cannot do something, which he is being accused of and that Jiah's mother should have counseled her not to date a 22-year-old boy when Jiah herself was 25.

This sounded a bit rich coming from Zarina as she herself is married to a man much younger to herself. However, inspite of all the alleged evidence, is Suraj innocent as his mother is claiming or is he indeed guilty of abetment to suicide?

Legally speaking, according to the Indian Penal Code Section 306, “If any person commits suicide, whoever abets the commission of such suicide, shall be punished with imprisonment of either description for a term which may extend to ten years, and shall also be liable to fine.” The person implicated for abetment to suicide is also culpable to homicide and it is a non-bailable offense.

Talking to Imran Ali, an Advocate, a number of points became clearer. “Abetment is proved through circumstantial evidence, which in this case is the letter as it is a crucial evidence. Although the letter is not addressed to anyone but there are doctor's reports supporting the facts stated about her abortion. Secondly, even abortion is not legal if it is done against the woman's wish. It is not black and white and someone creating some condition whereby she had to abort her child would also be abortion against her wishes,” he told this citizen journalist .

He also added, “Suraj Pancholi is not a small fry that he cannot get out of the legalities of the case. It must be that the Police have enough and good evidence to keep him under lock and key. The evidences are really good so that the magistrate is satisfied of an abetment case. It can be assumed given his parentage that he must be represented by a good lawyer and that they must have defended him, submitted bail application that must have been rejected.

As far as the legality of the incident goes, Pancholi seems to be in a tight spot. Advocate Ali also said that it is neither a very strong or very weak case. But Bollywood seems to be with Suraj Pancholi as various actors have come out to support him. Filmmaker Sanjay Gupta, who is Aditya Pancholi's friend, told hindustantimes.com, “One child has already gone. Now why are we killing the other child with this media trial? One needs to understand that Sooraj is a young boy and the stigma attached to this controversy is affecting his life both personally and professionally.” Sonam Kapoor, Mahesh Bhatt and Raveena Tandon has also said that Suraj should not be blamed for someone else's depression.
