If First Appellate Authority didn't respond to the first appeal (complaint converted into appeal by UPSIC), the info-seekers had no other option but to move second appeal to UPSIC and wait for its hearing.
SINCE MORE than a year, Uttar Pradesh State Information Commission (UPSIC) was not accepting any complaint under section 18 of Right To Information Act. All these complaints sent to UPSIC by info-seekers were being converted into first appeal of section 19 (1), sent to the First Appellate Authority and the complaint disposed-off at the time of first hearing.
In this way info seekers were big losers of their precious time. If First Appellate Authority didn’t respond to the first appeal (complaint converted into appeal by UPSIC), the info-seekers had no other option but to move second appeal to UPSIC and wait for its hearing.
We took up the issue with UPSIC, the Governor and the Chief Minister’s office. After rounds of talks and correspondence, we have succeeded in our efforts. Now, UPSIC has started entertaining complaints of section 18.
This will now help the information seekers to get information timely and efforts would not be wasted in bureaucratic red tape. It is time that the government and administration accept the RTI in letter and spirit.
So, now all can file complaints u/s 18 with UPSIC and the same shall be entertained.
