Uttarakhand High Court takes EVMs used in Vikasnagar Assembly election into custody
The Uttarakhand High Court has ruled that Electronic Voting Machines (EVMs) used for Uttarakhand Assembly elections in the Vikasnagar constituency will be taken into judicial custody.

The ruling came after the court admitted a petition by a Senior Uttarakhand Congress leader, Nav Prabhat, who lost the election from Vikasnagar.

Prabhat has challenged the election of BJP's Munna Singh Chauhan from Vikasnagar on the basis that the EVMs used for polling in the constituency were rigged.

The opposition parties have alleged that the BJP's landslide win in Uttarakhand and Uttar Pradesh was because of tampered EVMs, even though the Election Commission (EC) has strongly held its stand that EVMs cannot be rigged.

The Uttarakhand High Court has served notices to the EC, the state poll panel and Chauhan and has asked them to file their replies within six weeks. The court has also directed the EC not to use the EVMs used in Vikasnagar for any elections till further orders.

The EVMs used in the Uttarkahand elections have not been used according to the rules, since voting machines deployed for one election cannot be used again for at least two months. For elections on the 70 Assembly seats in Uttarakhand, about 11000 EVMs were used out of which 139 EVM sets were used in Vikasnagar.

The BJP has dismissed allegations of EVM tampering claiming that these are mere excuses used by the parties that have lost the elections.

Delhi Chief Minister Arvind Kejriwal has also been accusing the BJP of tampering with the EVMs and has time and again demanded that EVMs be used with Voter Verified Paper Audit Trails (VVPATs).
