Wives accused of adultery must get alimony
The National Commission for Women has asked the government not to amend section 497 (Anti-Adultery Act) and treat women as ?victims? of adultery, thereby paving the way for payment of alimony to adulterous wives.

CALL IT “unbelievable” if you wish. But, the National Commission for Women has decided to contest in the Supreme Court of India, section 125 of CRPC. Amongst the provisions that the Commission wants a review is an increase in the amount of interim maintenance for women by not less than 30 per cent of the husband’s monthly income. The Commission also wants the provision that deprives a wife from claiming maintenance if she is living in adultery to be deleted. “This provision is mostly misused and adultery cases framed against a woman to deny her basic expenses,” NCW chairperson Girija Vyas said. It has also decided against making Alimony Act gender neutral since, according to the NCW, a majority of households still have men as breadwinners.

Outrageous, insulting and unjust, one may say, but the NCW is doing every bit it can do and is trying every trick in the rule book to ensure that adulterous women get away with their crime and their unfortunate husbands are made to pay maintenance to them. In another recommendation, it has asked the government not to amend section 497 (adultery) and treat women as ‘victims’ of adultery. Under IPC 497, men alone can be prosecuted; women cannot be punished for adultery.

Some people may argue in favour of the NCW plea with regard to misuse of the said provision relating to denial of alimony quoting adultery. It is like saying, “I have a cold and as a solution, I will chop-off my nose.”

It is high time civil society wakes up to this growing tendency of the NCW going overboard in the guise of women empowerment. Men in particular, need to be organised in order to fight and defend their rights.

.I too am an victim of adulterous wife. She is having sexual relationship and vividly described her encounters with this married muslim guy. I have been married for 12 years +. She has confessed in her handwriting that she was in love with this guy since college days. This muslim guy is married to a hindu girl and having 3 children. To give an insight of the power enjoyed by women, my wife is openly challenging me to do whatever I like. She is not having any remorse of the deeds neither willing to give a divorce. Her parents and relatives are whole heartedly supporting her behaviour. She has left my house with her parents with her own will. She has even taken away my 10 year daughter from school directly without my consent. Now my daugter is not going to school. She is spoiling her future too. She is not allowing me to talk to my daughter also. They dont lift up the phones. Such is the power granted by law to these women thaey have no fear of society. I request comments and suggestion from learned people to get me divorce. Is the handwritten confession enough of such evidence. I wish to file petition for divorce shortly. Rohan, This has happened a way back. She left my place on 23rd Dec2008 and took my daughter on 23rd Jan 2009. I understand of IPC 498A, but dont think she will be filing such a case. However they have full intention of harassing me. I guess dowry harassment does not come into play after such a long period of marriage.
Yes, you can file a complaint against the other man. It would be an adultery case under 497, I believe. But since your wife has left you with her daughter, I advice you to take an anticipatory bail for IPC 498A. Otherwise, she may use the law to harass you. If you have taken an anticipatory bail, you cannot be arrested. The trick which they play is: File a dowry harassment case under IPC 498A and the police will arrest you on a Friday night at 2 AM. Then, till Monday or Tuesday, you cannot get bail. Their intention is to hurt you and humiliate you.

.I am also a victim of an adulterous wife. she ran away with a boy after marriage and she is contesting case against my divorce case. i am lucky that she herself confessed her deeds with that boy. now judge asked us to gofor mutual consent divorce. Coming to the point...... If you take marriage to be like joining of two bodies then adultry is not a sin and it can be encouraged as like it is done by national comission for woman. On the other hand If marriage is considered to be the joining of two hearts, and if you speak that marriages are made in heaven then adultry is a offence and it should be punished severely. Adultry must be considered as a crime, because it is killing of heart and soul. May it be a male or a female, adultery must be punished with highest degree of punishment

.Indian Legislators, Take it from your brothers in the US, this is a very slippery slope. We had similar legislation get passed here in the US back in the 1970's. What happened? Divorce rates skyrocketed from the teens up to 50%. Adultery rates similarly documented to be less than 15% durin Mckinsey's era (1960's) sky rocketed to the modern rate of up to 60% if Newsweek is to believed. We now have a majority of American children growing up in single-parent (i.e. fatherless) homes. This kind of legislation destroys morality and rips apart families. Don't to it.
