The officiating Chief Secretary of H.P. today filed an application in the High Court to recall/modify the orders dated November 18 of the Court directing the government to 43 Officers of doubtful integrity to non-sensitive posts.
The Division Bench comprising of the Acting Chief Justice Mansoor Ahmad Mir and Justice Kuldip Singh directed the Registry to list the application before appropriate Bench on December 6.
In the application moved in the Court, the Officiating Chief Secretary submitted that the previous orders dated November 18 of the Court mentions the statement of the Additional Advocate General that the process is going on for shifting 43 Officers of doubtful integrity, who are posted on sensitive posts, to non-sensitive posts.
The Officiating Chief Secretary submitted that the assurance was made by the Additional Advocate General inadvertently and no such assurance was made in the affidavit filed by him on 16.11.2013 and only the detail of competent authorities, who were consulted while posting such officers on sensitive posts, were given in the said affidavit as sought vide orders dated 14.11.2013 of the Court. He further submitted that it is always the effort of the govt. to avoid posting of such officers in sensitive posts, but since non-sensitive posts are not there in all cadres and hence, it may become unavoidable to post some officers in posts, which cannot strictly be termed as non-sensitive.
As the previous orders dated 18.11.2013 were passed by the Divison Bench comprising of Justice Kuldip Singh and Justice Dharam Chand Chaudhary, therefore, the application to recall/modify the orders will also be placed before the same Bench on December 6.
